The akua-store.eu. website allows for the purchase of various products, including online courses, educational and marketing materials, as well as clothing items and gadgets associated with the BRENTI MEDIA Sp. z o.o. brand. 2. Definitions
For the purposes of these terms and conditions, the following terms are defined as follows:
- Store: the online store accessible at www.akua-store.eu.
- Buyer: any natural person with full legal capacity, any legal entity, or a legal entity without legal personality.
- Consumer: a natural person entering into a contract with the Seller not directly related to their business or professional activity.
- Terms and Conditions: these terms and conditions available at www.akua-store.eu.
- Seller: BRENTI MEDIA Sp. z o.o, Raciborsko 551, 32-020 Wieliczka, NIP: 6832139898.
3. Preliminary Provisions
- The Seller offers the Buyer the possibility to enter into contracts for the sale of physical products available in the Store, for the provision of digital content in the form of online courses, and for other electronic products described on the Store’s pages, such as e-books, webinars, and printable files.
- The Terms and Conditions define the rules and conditions for using the Store, as well as the rights and obligations of the Seller and Buyers.
- The use of the Store does not require any specific technical conditions for the Buyer’s computer or other device. The following are sufficient:
- access to the Internet,
- a standard operating system,
- a standard web browser,
- an active email address.
- The Buyer cannot make a purchase in the Store anonymously or under a pseudonym.
- It is prohibited to provide illegal content while using the Store, especially by sending such content via the forms available in the Store.
- The prices of products visible in the Store are the total prices for the products, including VAT.
4. Services Provided Electronically
- The Seller provides electronic services to the Buyer through the Store.
- The primary service provided electronically is the ability for the Buyer to place an order in the Store, leading to the conclusion of a contract with the Seller.
- When the Buyer creates an account in the Store, the Seller provides an electronic service consisting of maintaining the Buyer’s account in the Store, where the Buyer’s data and the history of their orders in the Store are stored. The Buyer logs into the Account using their email address and a password they have defined.
- The Buyer can delete their account in the Store at any time.
- If the Buyer decides to subscribe to the newsletter, the Seller also provides an electronic service consisting of sending the Buyer emails containing information about new products, promotions, products, or services of the Seller. Subscription to the newsletter is done by filling out and submitting the newsletter subscription form or by checking the appropriate checkbox during the order process. The Buyer can unsubscribe from the newsletter at any time by clicking the unsubscribe button visible in each message sent as part of the newsletter or by sending an appropriate request to the Seller.
- The services provided electronically to the Buyer are free of charge. However, sales contracts and contracts for the provision of digital content entered into via the Store are subject to payment.
- To ensure the security of the Buyer and the transmission of data in connection with the use of the Store, the Seller takes technical and organizational measures appropriate to the level of security of the services provided, particularly measures to prevent unauthorized access and modification of personal data by unauthorized persons.
- The Seller takes measures to ensure the proper functioning of the Store. The Buyer should inform the Seller of any irregularities or interruptions in the functioning of the Store.
- Any complaints related to the functioning of the Store can be submitted by the Buyer via email to hejka@akua-store.eu. The complaint should include the Buyer’s name, address for correspondence, and the type and date of the irregularity related to the functioning of the Store. The Seller will consider all complaints within 14 days of receiving the complaint and inform the Customer of the decision via the email address provided by the complainant.
5. Placing an Order
- The Buyer can place an order as a registered customer or create an account during the order process via the Store.
- The order is placed by filling out the order form after adding the desired products to the cart. The order form requires the provision of information necessary for the fulfillment of the order. During the order process, the Buyer also selects the delivery method for the ordered products and the payment method for the order. The condition for placing an order is the acceptance of the Terms and Conditions, which the Buyer should read beforehand. In case of any doubts regarding the Terms and Conditions, the Buyer can contact the Seller.
- After clicking the order completion button, the Buyer is redirected to the payment gateway according to the chosen payment method. After successful payment, the Buyer is redirected back to the Store’s page with an order confirmation. At this point, the contract between the Buyer and the Seller is considered concluded. The order confirmation will be sent to the Buyer at the email address provided in the order form.
- Depending on the subject of the order, a specific type of contract may be concluded between the Buyer and the Seller:
- for physical products, a sales contract,
- for online courses and other electronic products, a contract for the provision of digital content.
- If the order includes products of different types, placing the order leads to the conclusion of several specific contracts corresponding to the subject of the order.
- The Buyer must provide accurate personal information in the order form. The Buyer is responsible for providing false personal information. The Seller reserves the right to suspend the fulfillment of the order if the Buyer has provided false information or if such information raises reasonable doubts about its accuracy. In such a case, the Buyer will be informed by phone or email of the Seller’s doubts. In this situation, the Buyer has the right to clarify any circumstances related to verifying the accuracy of the provided information. If the Seller does not have sufficient information to contact the Buyer, the Seller will provide all necessary explanations once the Buyer contacts them.
- The Buyer declares that all information provided in the order form is true and that the Seller is not obliged to verify its accuracy, although it has the right to do so under section 7 above.
6. Delivery and Payment
- The payment methods available for the order are described on the Store’s pages and presented to the Buyer during the order process.
- The delivery methods available for physical products are described on the Store’s pages and presented to the Buyer during the order process. The cost of delivery of the order is borne by the Buyer unless otherwise stated by the Seller on the Store’s website.
- Electronic payments are processed by PayU, Przelewy24, PayPal.
7. Electronic Products
- The fulfillment of an order including an electronic product is carried out by sending to the email address provided by the Buyer in the order form a message containing instructions for downloading or accessing the purchased electronic product.
- Delivery will occur immediately after the Buyer makes the payment, no later than 24 hours after the payment.
- Upon sending the message referred to in section 1 above, the digital content subject to the order is considered fully delivered to the Buyer.
- To use the products properly, it is sufficient for the User to have a standard operating system and appropriate software as indicated on the product page.
- Under the contract concluded in accordance with the provisions of section 4 of the Terms and Conditions, the Seller only provides the User with the digital content in the form of the electronic product purchased by the User. The Seller is not obligated to provide any assistance to the User in using the product.
